Throughout the website, the terms “we”, “us” and “our” refer to Ceremonial Cosmetology and its affiliates. Ceremonial Cosmetology offers this website, including all information, tools, offerings, products, and services available from this website to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

Please read these Terms of Service carefully before accessing or using our website, products, or services. By accessing or using any part of this website, you agree to be bound by the terms and conditions of this Agreement, which constitutes the entire agreement between you, Ceremonial Cosmetology, and its affiliates. If you do not agree to all of the terms and conditions in this agreement, then you may not access the website or use any of our products or services. This agreement supersedes all prior and contemporaneous agreements, representations, warranties, and understandings, whether oral or written, with respect to the website, the website contents, and any information, resources, products, or services offered on the website. In the event of any conflict between this agreement and any other agreement or understanding related to the use of the website and its offerings, this agreement shall control. You may not use our resources, products, or services for any illegal or unauthorized purpose nor may you violate any laws in your jurisdiction (including, but not limited to, copyright laws). 

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms of Service.

CHANGES TO THE TERMS OF SERVICE

Any new features, information, products, or services which are added to the current website shall also be subject to these Terms of Service. This Agreement may be amended by Ceremonial Cosmetology or its affiliates from time to time, and your only notice of such amendment shall be the posting of the amended Terms of Service on this website. We reserve the right to update, change, or replace any part of these Terms of Service by posting updates and/or changes to our website. You are therefore advised to review the Terms of Service each time you visit the website. Your continued use of or access to the website following the posting of any changes constitutes your acceptance of those changes. 

COMMUNITY POLICY

This website and all affiliated social media handles are intended to be a safe and inclusive space for all visitors, clients, users, and customers. Any person(s) who threatens this community in any way are subject to being blocked or banned with or without notice. We also reserve the right to refuse service/business to anyone for any reason at any time. We reserve the right to discontinue work with written notice, sent via email, if an unresolvable issue is to arise between Ceremonial Cosmetology or its affiliates and a customer, client, or user.

User comments, feedback, and other submissions

If, with or without our request, you send us submissions such as, but not limited to: creative ideas, suggestions, proposals, plans, resources, or other materials, whether online via comments, DM, email, or website, or via postal mail or otherwise (collectively from here, “comments”), you agree that we may, at any time and without restriction, edit, copy, publish, distribute, translate, and otherwise use in any way comments that you forward to us. We are and shall be under no obligation to (1) maintain any comments in confidence, (2) to pay compensation for any comments, or (3) to respond to any comments. 

We may, but have no obligation to, monitor, edit, or remove content that we determine in our sole discretion as unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene, or otherwise objectionable, as well as any content that violates any party’s intellectual property or these Terms of Service.

You agree that your comments will not violate any rights of us or any third-party, including copyright, trademark, privacy, or other personal or proprietary rights. You further agree that your comments will not contain libelous or otherwise unlawful, abusive, or obscene material, and/or contain any computer virus or other malware or code that could in any way affect the operation of our services or website.

You may not use a false email address, pretend to be someone other than yourself, or otherwise mislead us and/or third-parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third-party. 

LIMITED RIGHT TO USE

The website and the contents herein are the intellectual property of Ceremonial Cosmetology and its affiliates, and are protected by applicable copyright, trademark, and proprietary rights. The viewing, printing, copying, or downloading of any content, graphic, form, image, or document from this website grants you only a limited nonexclusive license for your personal use and does not authorize republication, distribution, assignment, sublicense, sale, preparation of derivative works, or any other use unless you have received Ceremonial Cosmetology's expressed written permission for such use. 

No part of any content, form, image, or document may be reproduced in any form or incorporated into any information retrieval system, electronic or mechanical, other than for your personal, not-for-profit use. You do not acquire any ownership rights to the website or to any contents herein. All rights not expressly granted herein are reserved by Ceremonial Cosmetology.

In addition, you are also prohibited from using the website or its content: 

  • for any unlawful purpose;

  • to solicit others to perform or participate in any unlawful acts;

  • to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances;

  • to infringe upon or violate our intellectual property rights or the intellectual property rights of others;

We reserve the right to terminate your use of our website or related websites, products, or services for violating any of the prohibited uses. 

PRIVACY POLICY

Ceremonial Cosmetology has taken important steps to ensure that your personal and payment information is secure and that your privacy is respected. Ceremonial Cosmetology will never sell, trade, distribute, or share customer, client, or user information, such as: name, email address, phone number, mailing address, or payment information. Here's what we do with the information you provide:

E-Mail Addresses, Mailing Addresses, and Phone Numbers

You will be added to our email list if you choose to opt-in at checkout or through our website. We use your mailing address to fulfill orders, and when your email or phone number is obtained by us as the result of you placing an order for a physical product, we only use your email or phone number if there is a problem with your order. We may also use your email address or phone number to contact you about in-person or virtual services that you have directly reached out to us about through our contact pages.

Credit Card Information

We use the credit card information you provide when ordering to bill you for the products you order from Ceremonial Cosmetology. Your credit card information is encrypted with the latest SSL technology. Upon placement of your order, the credit card processing company checks the information you give against information they have on file for you, along with other fraud monitoring measures to ensure credit card security. An email will then be immediately sent to you outlining your order and the amount that has been charged to your card. Ceremonial Cosmetology is NOT given your credit card number when being notified of your order details: we are only given information regarding the type of card used (i.e. Visa, Discover, Mastercard, etc.). For PayPal, Venmo, and Cash App transactions, we do not receive your payment information: these payment services only provide us with your name, username or email address, shipping address (when relevant), and order information.

You understand that your content or information (not including credit card information) may be transferred unencrypted and involve (a) transmissions over various networks, and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks. 

FDA DISCLAIMER

The statements made on this website regarding our products and services have not been evaluated by the Food and Drug Administration (FDA). The efficacy of these products, and the testimonials made, have not been confirmed by FDA-approved research. Our products and services are not intended to diagnose, treat, cure, or prevent any disease or ailment.

Ceremonial Cosmetology and our affiliates do not make any health claims about our products or services. Eligibility

Products and services sold by Ceremonial Cosmetology are intended for use by individuals 18 years of age or older. You must be 18 years old or older to purchase. For any products containing CBD, you must be 21 years of age or older to purchase. By purchasing, you agree that you are of legal age in your state, county, country, province, or territory to purchase these products. 

Liability

By using this website, you agree that anything you choose to do with the information, resources, offerings, products, or services provided here is solely at your own risk. 

Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law. 

Ceremonial Cosmetology’s information, products, and services come with NO guarantee of effectiveness and have NOT been reviewed or approved by the FDA. Every person’s body is uniquely variable; therefore, our products and services may have varying effects on each individual who is using them. Our products and services are not guaranteed to ‘work’, have an effect, work the same way across different individuals, or even work the same way over time within the same individual. We are not responsible if information made available on this website is not accurate, complete, or current. Ceremonial Cosmetology's products do not contain any substances or plants illegal under U.S. Federal Law.

We do not guarantee that the quality of any of our products, services, information, or other items purchased or obtained by you will meet your expectations, or that any errors will be corrected. We do not guarantee, represent, or warrant that your use of our website or services will be uninterrupted, timely, secure, or error-free. We reserve the right, but are not obligated, to limit the sales of our products or services to any person, geographic region, or jurisdiction. We may exercise this right on a case-by-case basis. You agree to understand that from time to time we may remove our offerings, information, products, services, or website for indefinite periods of time, without notice to you.

We reserve the right to limit the quantities of any products or services that we offer. Prices for our products and services are subject to change without notice. Occasionally there may be information on our website or its contents, and/or our products and services, that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times, and availability. We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information and/or cancel orders if any information here or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).

ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer, client, user account, or credit card, as well as orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors.

You agree to provide current, complete, and accurate purchase and account information for all purchases made at Ceremonial Cosmetology. You agree to promptly update your account and other information as needed, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you if needed. 

SHIPPING POLICY 

All communications regarding orders must be sent via email to ceremonial.cosmetology@gmail.com.

Currently, Ceremonial Cosmetology can only ship to the continental United States. If you live outside of this area, but would like to place an order, please inquire at ceremonial.cosmetology@gmail.com BEFORE ORDERING. There are no guarantees that we can ship to you.

All of our products are uniquely designed, prepared, handcrafted, processed, packaged, and shipped by one person. Please plan accordingly prior to purchase: the current wait time on most of our products is at least 1-2 weeks before they will be shipped. If you need something shipped urgently, please contact ceremonial.cosmetology@gmail.com BEFORE ORDERING to inquire about your request. There are no guarantees we can accommodate you. Although the wait may be long for many of our products or services, our customers can rest assured knowing that their products were made with the highest quality of ingredients, research, honor, and intention. 

If you have not received a tracking number, then your order is still processing and has not yet shipped. Shipping occurs after your order has been fully processed by Ceremonial Cosmetology and has been received by USPS (or an alternative courier). You will receive an email with full tracking details once USPS (or an alternative courier) receives your package. 

Shipments usually arrive within 2-10 business days (in the continental US) after being received by USPS (or an alternative courier). Please allow at least 14 business days to pass before contacting Ceremonial Cosmetology or any of our affiliates about an order that has not yet shipped, and/or an additional 10 business days from the ship date before contacting us about an order that has been shipped.

Those who initiate charge backs, demand refunds, or hassle us about these Terms of Service will be banned from purchasing at Ceremonial Cosmetology. 

Your purchase from Ceremonial Cosmetology validates the following shipping agreements: 

  • You agree that you have provided a correct and secure mailing address. You will not be reimbursed by Ceremonial Cosmetology or any of its affiliates for any packages lost due to misspelling of addressing, missing unit numbers, incorrect zip codes, etc. Please be sure to verify your shipping and billing information while placing an order. For security reasons, we cannot make changes to the address. If your package returns to us, we will reship it for an additional fee (please contact us at ceremonial.cosmetology@gmail.com to request this service).

  • Ceremonial Cosmetology or its affiliates are not responsible for packages once they leave our facilities. You agree not to hold Ceremonial Cosmetology or its affiliates responsible for a package that is lost or damaged by USPS or any other courier. 

  • You agree that Ceremonial Cosmetology or its affiliates are not responsible for any package that is stolen from the delivery location.

  • Refunds will not be issued for items lost or damaged by USPS (or any other courier) as we closely follow shipping & packaging standards which ensure your items make their journey to you safely. Once a package leaves our hands, it is out of our control.

  • You as the customer/client are responsible for filing a claim for a refund through USPS (or any other courier) if your package has been damaged or lost. Please contact USPS (or the appropriate courier) to file a claim.

  • If your package is lost in transit, you agree that Ceremonial Cosmetology or its affiliates will not be held responsible if the tracking information says the package was “delivered,”  which indicates that USPS (or another courier) successfully delivered the package to the specified address.

  • International customers/clients: you are agreeing that your package does not come with insurance and tracking (beyond the US Border) and that no refunds will be issued due to damage, customs seizure, or loss.

  • International customers and clients are responsible for paying any import taxes owed.

  • All customers and clients, Domestic and International, agree that you are solely responsible for following your own State's/Country’s regulations regarding the products you purchase.

  • No returns, cancellations, refunds, or exchanges can be made after an order has been shipped. If you have any other questions regarding shipping, please email ceremonial.cosmetology@gmail.com. 

RETURNS, REFUNDS, AND/OR EXCHANGES

All communications regarding orders must be sent via email to ceremonial.cosmetology@gmail.com. Communications via any other method will not be answered unless an affiliate of Ceremonial Cosmetology has explicitly requested such communications.

All sales are final. Please contact us at ceremonial.cosmetology@gmail.com to attempt to cancel your order and request a refund. We do not guarantee that we can cancel or edit your order. On the rare occasion that we might edit, cancel, or refund your order, it is only possible to do so BEFORE the order has shipped.

Your purchase from Ceremonial Cosmetology validates the following agreements:

Physical products

  • Given the nature of our offerings, products, and services, our policy is that returns, refunds, and/or exchanges are not permitted for any reason. If this occurs, please contact us at ceremonial.cosmetology@gmail.com and we will do our best to make things right.

  • If there is an issue with an order that you have received, such as a broken item, email ceremonial.cosmetology@gmail.com with your order number, the issues, and photos of proof. Please allow at least 72 hours for a response.

  • We do not accept returns, refunds, and/or exchanges based on product effectiveness, taste, smell, feel, texture, appearance, color, consistency, effects, reactions, etc.

  • You as the customer, client, or user have the right to make an informed decision prior to purchase. Your purchase demonstrates your absolute assumption of liability. 

  • Refunds will not be issued for items lost or damaged by USPS (or any other courier) as we closely follow shipping & packaging standards which ensure your items make their journey to you safely. Once a package leaves our hands, it is out of our control.

  • International customers/clients: you are agreeing that your package does not come with insurance and tracking (beyond the US Border) and that no refunds will be issued due to damage, Customs seizure, non-delivery, or loss.

In-person or virtual services

  • There will be no returns, refunds, or exchanges, under any conditions whatsoever, for any non-physical products, offerings, or resources, whether given in-person or online.

  • If you need to reschedule an online or in-person session or appointment, please send an email to ceremonial.cosmetology@gmail.com as soon as possible. We require a 24 hour notice to cancel or change an appointment time. If you made a deposit (required for all in-person services), it will be applied to your next appointment. If there are < 24 hours notice, the deposit will not be refunded and the client will be charged 100% of the appointment fee, and/or a $40 rescheduling fee.

INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Ceremonial Cosmetology and all of our affiliates (including, but not limited to, our subsidiaries, owners, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees), harmless from any claim or demand, including reasonable attorneys’ fees, made by you or any third-party due to or arising out of your breach of these Terms of Service, the documents they incorporate by reference, and/or your violation of any law and/or the rights of a third-party. 

SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service. Such determination shall not affect the validity and enforceability of any other remaining provisions. 

TERMINATION

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us in writing that you will no longer use our products or services, or when you cease using our website.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination. In this scenario, we may also deny you access to our website, products, and services (or any related part thereof). 

CONCLUSION

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision. These Terms of Service and any policies or operating rules posted by us on this website or in respect to our information, products, or services, constitutes the entire agreement and understanding between you and us, as well as governs your use of the information, products, or services, superseding any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party. 

GOVERNING LAW

These Terms of Service and any separate agreements whereby we provide you products or services shall be governed by and construed in accordance with the laws of the United States.
